Mutilation

By mutilation I mean the destruction or removal of any
conspicuous part of the human body that is
endued with separate motions or specific
functions, the loss of which the extinction of life is
does not the necessarily consequence produce extinction of life. –Such as the eyes,
the tongue, the hands, the feet &c.
There are certain parts about the head that the nose and ear the extirpation of which might from ambiguity of
the language be improperly taken for mutilation

As to the extirpation of the nose and ears
this cannot is not mutilation property so called,
the reason is that it is not the the removal of the external prominent
part of those nose members would not entirely
put a stop to the exercise of those functions to
which are they are respectively adopted: they
contributed to the faculties of hearing & seeing,
but they do not constitute those faculties. There
Hence there is an essential distin difference
between that species of mutilation which
produces the total destruction of the organ itself
& that which destroys removes only a member by which
the organ is protected. This is a species of
disfigurement, the effect of which may to a
certain degree be remedied by artificial contrivances.

In point of continuance, mutilation is not
susceptible of distinction like Deformation and
Disablement. Mutilation can be no otherwise
than perpetual. The privilege which nature
has given to many of the less perfect animals –
the faculty of renewing their perished members –
has not been communicated denied to man.
