Inconvenience of complex Punishment

The inconvenience of attending those very complex
modes of punishment are great but they
may be are soon stated in a small room. The Legislator
knows not what it is he does: the subject knows
not what it is that is threatened to be done to him. It
becomes impossible for the Legislator in any
one instance to do right: in every instance he umst either
do too little or too much. The illusion of
a dark and inexpressive uncharacteristic nomenclature raises
up a thick mist before his eyes: he scatters
mischief blindfolded. The subject is oppressed:
the Judge provoked and scandalized: and disgusted Detesting the Law which he has sworn to execute he overthrows it by setting up a new one of his own, making or evades it by falsifying the past: and the
mischief introduced by the indolence of the Legislator are palliated
by perjury and usurpation of the Judge.

The Legislator or the Judge, (according to
whose lot it falls,) for the sake of inflicting
one mode of punishment that is of use, are obliged
to inflict ten or a dozen that are incapable of answering
no any end at all. Under favour of the confusion
modes of punishment, or rather of pure mischief
(since they are incapable of answering any end
good or bad which punishment ever proposed
to itself modes of mischief, I say,) the most irrational and absurd atrocious pass current and are [inflicted] made to take place along with the
rest: are punishments which the Legislator or the
Judge would shudder at if proposed to them
