here of the corporal application which constitutes
what one would commonly mean by the in speaking of the
punishment. This would produce for a certainty a certain
quantity of pain of apprehension grounded on
the prospect of the distant contingent inconveniences
to which the patient would see himself exposed by
the consequences of the operation.† † See BI. ch. These inconveniences
could indeed be eminently uncertain: but the as
there is some part of the complex mass of punishment certain, the
objection with respect to them applied to the regards comes not under
this topic of head, but that of equability: for it is the uncertainty
which of those minute and numerous ingredients
in the whole-ness of punishment will
take place in the instance of any individual delinquent considered
at the time of the corporal application,
that makes the whole mass consider'd with respect
to any number of and delinquents unequable.
By The events thus here spoken of as uncertain are I mean unforeseeable events:
not to be foreseen: not of circumstances of the number of those which
influence the sensibility of the delinquent, and
may be seen at the time of sentence may be seen
to do so.
In point of variability the this whole class of punishment
now before us when taken together, are not liable to much
objection: from the lowest to the highest runs a
scale that admitts of a very considerable variety of degrees.
