Latitude and variety of the restrictive class of Punishments

Restraints on occupations unaccompanied with local confinement can never never make any less drop great figure
in a system of punishments. The occupations from
which a man may by possibility be debarred are
either necessary or not necessary. From necessary
occupations such as to eat, to drink to sleep, a man
can not be debarred without loss of life. Occupations
not necessary may be distinguished into pleasurable
and useful. By pleasurable I mean such as are
productive of pleasure at the time: by useful I mean
such as are necessary gone through in the pursuit
of pleasure. For how can the op any thing be said to be of use but as a means more or less immediate of producing pleasure, or (which comes to the same thing) of repelling pain? Under this head may be comprized lucrative:
such to wit as are exercised in the view of
obtaining money: money the or standing representative of
the whole body [company] band of pleasures; as well as the antagonist of
the whole band of pains.

As many acts then or occupations as a man
can have occasion to perform, so many kinds might
there be of a restrictive prohibitive punishment. There is no regulation Every obligation
that that whatever of the prohibitive kind but what if [considered such
in a certain point of view] may] were the intention of the Lawgiver in establishing it, might not be consider'd as a
punishment of this class. In the same manner may
any punishment regulation of the active mandatory kind be considered
as (inducing a punishment of the active kind class] inflicting
a species of active punishment. For Law And these
two kinds compose the form together the whole matter
of the Law. By Accordingly every thing that can come under the
name
