Imprisonment
name of Law is of itself an evil: when it produces
good, it is in virtue of it's distant consequences.
For every Law that is not
For laying those out of the question which trespass upon
personal liberty security, every Law is brought established at
the expence of, is a partial infringement on personal liberty
of the one kind or the other: for on that which is opposed
to constraint restraint or on that which is opposed to
constraint. We may see therefore by the by, what
truth and what precision there is in the language
of those who will not have evil done that good may
come of it; who will not have a Law that is
an infringement upon liberty; who will not have
a Law that [is not made by] has not the consent of the
majority of those who are to be bound by it.
To distribute the possible kinds of restrictive punishment
would be to distribute the infinite variety of
acts which men can have a desire to perform,
of occupations which they may wish to exercise.
To pursue this distribution few systematically would evidently be an endless
and for the purpose in hand an unnecessary task.
From the indefinite mass of those acts operations and occupations
it will be proper in the 1st instance to select
those the effect of which is to produce a
change of place in the whole person of the party
moving: Because acts the interdiction of which is a restraint upon
