Imprisonment

Under the third head I shall enumerate The third shall consist such
hardships as though accidentally they be apt in practise
to be connected with Imprisonment are foreign
to it's nature; since they all lead to point the way to a punishment
of a superior degree and of different denomination.
[I mean] the punishment of Death. They hardships are therefore foreign
to the any design which the Magistrate can have in inflicting
the punishment of death Imprisonment. For
if arises he meant to inflict the punishment capital punishment of
Death he would say so. He would not in words prescribe one
mode of punishment in words, and in effect another
incompatible with the former. These therefore may
with strict propriety of speech and not in the way
of declamation be stated Abuses incident to Imprisonment.
