Imprisonment, examined

The h 8th head of inconvenience is very open much exposed to this
objection. Some persons may be totally deprived of
their livelyhood by Imprisonment; while that of others
shall be very little affected by it. If the injury to
done to their by this means to a mans in the way of his business livelyhood is but temporary it is not
so much to be regretted; if it be perpetual operates
as a fine to such an amount the amount in question. But if his business
be of such a nature that if once suspended it is
irrecoverable, the imprisonment instead of a determinable
fine may amount to perpetual impoverishment.
These circumstances objects This circumstance might always
to be attended to and provided for by the Magistrate;
and in the instance where the mode of
punishment in question would be attended with such
fatal consequences, it would might be advisable for him
to change it into another. This other case remedy in general can scarcely be any other
than simple afflictive punishment. By Pecuniary punishment
is the most obvious substitute: but in the greater
part of the number instances in which in which punishment is inflicted it is for want of the
party's having wherewithal to undergo the other punishment.
There remain only Capital Punishm Permanent
Puni Corporal Punishments. Capital, & Laborious
Punishments and Territorial confinement & Banishment
& Simple Infamy. Capital Punishment is too Permanent Corporal Punishments
would either be too great in themselves or attended
with ore Infamy than Simple afflictive. Capital Punishments would be too
great. Laborious Punishment would besides being attended
