Imprisonment examined.
If any punishment that is at all calculated to be efficacious can in itself be popular,
[independently of it's connection in the way of
analogy with the offence] [I imagine it must
be this] this I think promises to be so. It bears comes
upon it more than any other nearer than an other to the character a stronger resemblance
than any other to Domestic discipline.
The tendency which it is seen to have to bring the
offender⊞ ⊞ to hold his misconduct in aversion and by that means thence to be convinced in a manner by hating the offence [to be out of humour to acknowledge be con] the
justice of the sentence, gives it cloaths it the character of Equaity
in the mind imaginations of mankind. This is exactly
the object which an indulgent parent has
in view in the punishment of his children.
The anxiety men express entertain to obtain that confirmation of
the Justice of their proceedings which is afforded
by the assent of him who is the victim of them,
breaks out shews itself [in various shapes] on in some a variety of occasions.
Actuated by this propensity, [Judges under the Civil
Law] the Roman Lawyers established the practise
of torturing a convicted criminal for the purpose
of extorting from him a forcing him to a convession. Thus also under
own Law the practice was till abolished by a
late act, to torture a culprit till he confessed
the right which if [assumed by] the Court assumed to try him.
To the same propensity we may impute in some
degree the industry which is generally employ'd
by the Ordinary to obtain a confessions from convicts
by the influence of his profession. [Two sentiments
