Territorial Confinement Quasi-Imprisonment &c.
Of the suffering, inconveniences attending Territorial Confinement and Banishment
little need be said. [The hardships inconveniences They import
are mostly of the nature of those of Simple Imprisonment,
only carried to a less degree.
By Territorial Confinement such of the Liberties
as are abridged by Simple Imprisonment, are
still more abridged but in a less degree. Such is the liberty of enjoying
the company of one's friends, relations and
acquaintance. It is easier for them to come to
a person thus confined, than if he were imprisoned.
But still he is equally debarred from the liberty of going
to them, unless by accident except in the case instance
of such as by accident may happen to reside in the
district to which he is confined.
Of the Liberties that are taken away by Simple Imprisonment
some are equally taken away also by Territorial confinement;
others only abridged. This we may
say considering it is a general view; but it
is obvious that nothing can be said on this subject in these behalf
that shall hold good in all cases; since in point
of closeness this kind of Confinement is susceptible
of an number of infinite gradations. The Liberty All that one
can say with strict propriety is that such a Liberty is apt to be
a more or less abridged: such another apt wholly
to be taken away. This observation I must beg the reader
to keep bear in mind and apply to every thing that is here said
on the subject now of Territorial Confinement.
