a rough kind, such as digging a ditch, or paving
a Court-yard. A Soldier or a party of
Soldiers according to the number of these convicts
thus employ'd, stands over them as a
guard.
This custom is also in use in Russia.[a]

The Abbè had particular reason to remember
it. Wanting the earth to be dug to have the earth dug for the purpose
of an experiment, he was complimented with the use of a dozen
of these poor wretches. Upon his giving them a
little money for themselves, they made the guard
drunk and escaped ran away. Vol 1, p. 149 12 mo Edit. Amst.

Indiscriminate servitude is part of the punishment
inflicted by our Law under the name
of Transportation. The Court contracts† † In virtue of the Stat. 4.G.1.c.11. with
th a certain person to convey the convict to
the place of destination: thereupon the convict
is made over "to the use" of the Master such person and his Assign, who
is declared in general terms to "have a property or interest in
the his service" & the convicts in for the time specified
in the sentence. No limitations are set by any
Statute Law to the kind of service which the
convict is compellable to perform: nor to the subsidiary
punishment by which he is liable to be compelled.
I know of no case where either of these points have
been debated upon the principles of the Common Law.
