Laborious Punishment.

An example taken from our own Law, will
serve to illustrate the destinations that [have been in
the course of this Chapter] have been laid down
in the course of the present Chapter. In the
late Act which has been already mentioned,
for substituting appointing a course of punishment
in lieu of Transportation. The principal punishment
is specific servitude: "the being kept employed in to public work set on foot for the improvement of the navigation of the River Thames.[a]

NOTE

[a] The Offender shall be kept says the Act, "to hard Labour, either in raising
"Land Soil and Gravel from, and cleansing the
"Thames, or in any other laborious service for the
"benefit of the Navigation of the Thames; but at
"such places only, and subject to such directions,
"limitations and restrictions, as the Master &c of
"the Trinity House shall from time to time prescribe."
Then follows "either a proviso limiting the kind of
employment still more narrowly. 16.G.2. ch.43. §.2.5.

IIXI

The subsidiary punishment to the hard labour
is "whipping": I wish I could stop here: but the
Act goes on and adds, "or such other such moderate
"correcting Punishment .... & as may be inflicted by
"Law on persons committed to a House of Correction
"for Hard Labour."
