Simple modes of Punishment. Simple Deaths
Mutilation is not susceptible of those distinctions
under of which Disablement and Deformation are
susceptible with respect in point to their continuance. Mutilation
can be by not otherwise than perpetual.
In England, every species of imaginable species of Mutilation of the ages were was formerly inflicted
by Common Law. but being so long But they have all been disused,
that it would possibly be deemed for so many centuries that one species only excepted, it⊞ ⊞ is not probably that any of them would be deemed now to be in force
is not to be . Mutilation of the Hand
is appointed in a singular case by Statute, &
therefore can not but be in force, though I can find
no instance of it's being (employed) put in practise.
We have now no possible method species of
corporal punishment left to consider, but capital:
[the punishment of Death.]
Capital punishment may be distinguished into
1st Simple. 2dly afflictive afflictive.
I call it simple when no pain bodily pain is
inflicted more than what is absolutely necessary to
produce the effect of Death: which is very trifling. I call it afflictive
when any degree of pain is produced more than what is
necessary or produced for that purpose.
I call it simple afflictive when it is attended
with more pain than any degree of pain more than what is necessary to produce the destiny
befo simple when it is not.
NOTE
I know not of any instance of its having been inflicted
in either of these highly intensely afflictive methods as a punishment,
by authority. The stores of Archbishop
Mutius Scævola and Arch-bishop Cranmer are well
known.
