Capital Punishment examined.

With respect to this the pain of apprehension it will
[here] occur that it this is no more than what is super-added
to every other kind of corporal punishment; so that if
the real suffering is equal to or negative (as is attendant on capital punishment considered) in other accounts inferior to every other kind of other punishment, it will still continue
so [on this.] when after this is has been taken into the account. But
we have already shewn that the proportion ratio
of the expected suffering to the eventual in death capital punishment is much greater
than in any other kind of punishment. But
that whether it be in general so great as that, added
to the pain attending organic part of the
punishment (which is we have seen to be next to nothing) it is
greater than the highest of all other punishments
added to the pain of apprehension grounded [which belongs to it] on
such that other punishment, is not very easy to determine.
The essential part however is to determine the relative quantity
of it as it appears is likely to bystanders, rather than
as it subsists in the person of one who has already
incurred the penalty. For the mischief of the
real punishment extends but a little way has but a small extent over through
the community, in proportion to the benefit of
the apparent. We see already reason enough to conclude that the former is
not of such magnitude as to constitute of itself any very formidable
objection to this mode of punishment.
