seems worst fit to enter into competition with this. Such
a punishment seems to be that which we have stiled
Laborious. It will still further abridge our task
if instead of comparing them in the abstract, we compare
them with reference to those cases delinquents in which it
is most likely that capital Punishment should be called
for.
These are of the most obdurate class of those who are
judged to be the most obdurate: whether from [the] experience
of the insufficiency of other punishment to reclaim
them, or from their venturing at once upon the commission
of the most flagrant malignant odious enormities. This solution
will save us the trouble of making the comparison
with simple afflictive punishment, Disablement,
Deformation, Imprisonment, Territorial
Confinement, Ignominy and Forfeiture pecuniary punishment.
With respect of offenders of this class the preference
seems to be pretty conclusively on the side of Laborious
Punishment. We have already had occasion to
shew that the most obdurate offenders are precisely
those on whom the punishment of Death is likely to
make [the least less] impression [than in others] an impression
less than ordinary. But for the same
reason that Death makes is less formidable, Laborious
Punishment is more so. A state of labour is a
state in which if a man can be happy, he may be
