sure of being happy. But the misfortune of the people in question
is that they can not be happy in that state. It is
[precisely in order to free escape themselves from] by flying from that state, that
they encounter Death.

It is not therefore without reason that M. Beccaria
concludes in favour of Laborious against Death
in the case [in question of criminals of the highest class,] though
whether the [preference is to be vindicate] ground upon
which he rests that preference is of itself sufficient
may not be quite so clear. He supposes that Laborious
Punishment of the Laborious kind moderate
we must suppose in its degree will be make a stronger
impression upon the higher class of criminals than
the most excruciative kind of Death that can be
devised. He supposes a punishment that extends runs out
in duration better calculated from that very circumstance
to make an impression that a punishment
(we will suppose of the same magnitude,) that runs
out into intensity. That with respect to men or of taken at large I am apt to think Notwithstanding such respectable authority the case is contrary
