Capital Punishment examined.

such as those which now distinguish Child murder,
Duelling, Homicide in self defence against Justice, Homicide in a sudden affray, or even
deliberate Homicide in a private quarrel. I will
pass on at once to the most dangerous species of
Homicide: Assassination for lucre: a crime proceeding
from a disposition which puts indiscriminately the life of every man
in the community indiscriminately into immediate jeopardy. Even these are
not so dangerous nor so difficult to manage as
madmen: because their former will committ Homicide
only where at the same time that there is something to be got by it,
and it can be committed perpetrated with a probability of
safety. Madmen are not The mischief to be apprehended from madmen
is not has not narrowed by either of these circumstances considerations
to narrow it. Yet For all this it is never thought necessary that
madmen should be put to Death. They are not put
to Death: they are only kept in confinement: and
that confinement is found effectually to answer the
purpose.

Upon the whole then it should seem that there seems to be scarce a case
in which the Death as a punishment can be employ'd it can be of use to employ Death in the way of punishment
to advantage. [The slight advantage it has in
point of exemplarity] It's want of variability were
there no other objection to it would render it unfit
for frequent use. In part of As a measure of particular
prevention
it has so no advantage over
close Imprisonment confinement: and the small advantage it has
in gen with respect to men in general in point of
exemplarity
