men sooner, in others later: nor can it well be said conjectured
without knowing the particular character & circumstances of
the individual one has to deal with, how long his
attachment to such or such a pleasure habit will last continue
to such a degree that the being debarred of it shall
continue to be a punishment. It is not however The
weakness of a man's attachment to any particular
kind o habit is not strictly properly speaking of itself the – [the only] reason why the prohibition
laid upon that habit should not be sufficient penal
enough
to answer in general the purpose of a punishment;
the reason is, the weakness of that habit in
comparison of the difficulty of enforcing the prohibition,
that is of the uncertainty of the subsidiary punishment
the honor of which is to compel him to submit to
the other primary one. A punishment of this sort
then seems liable in general to this dilemma. The
attachment to the habit practise is either weak or strong: if weak, the
prohibition is nothing as punishment is nothing; if strong, it will be
eluded.

These observations will help us to account for the
little notice we see figure we see taken of punishments of
this class in any system of Jurisprudence; at the same
time that they will serve to show prove [the reason] that they
deserve not
this neglect is not not to be without foundation.
