prevent persons of that persuasion from getting into
situations in which it was apprehended they would
do mischief. With regard to the general prospective exclusion
respecting Protestant other Nonconformists the in general public & ostensible intent seems
to have been generally the same as in the latter
case, I say the public and ostensible intent: for
in both cases, but more particularly in the latter,
the private motive of the framers of the Law was
probably principally perhaps the satiating gratification of that hatred, which
seems almost inseparable from Religious zeal.
But this private motive is not to our present purpose.
From the above reasons it will seldom happen
that a restraint on a respecting a particular mode of conduct point of principle
can be trusted [to] [singly] when single in the capacity
of a punishment. There are cases however
where on the score of analogy one punishment an article
of that sort may form an useful ingredient in
a complex mass of punishment. There will be mentioned
in the Chapter dedicated appropriated to that subject.
Accordingly The eligibility of such a punishment will accordingly depend
entirely on the particular character of the offence.
It would therefore be unreasonable here to pursue
the subject any further.
