Punishments Succedaneous.

Forfeiture of [any other possessions than pecuniary or
quasi-pecuniary] powers and political rights, conditions
&c are seldom inflicted but in cases where it appears by the offence itself
that the delinquent possesses the thing to be forfeited.

Imprisonment – in the first instance [or Quasi-Imprisonment] is the punishment
that seems comes in most connects naturally [to connect with] in aid of
pecuniary. As pecuniary is in the lowest degrees of
it the lightest of all uncertain punishments, Imprisonment
is the lightest of all certain ones. As
Pecuniary punishment admitts of the a greater number
of degrees and these the most more definite than any
other punishment of the uncertain class. Imprisonment
admitts of no great a number of degrees and
those as definite as can be required of in a punishment
of the certain class.

Pecuniary Punishment is that which always
ought to be and commonly is first resorted to of
all uncertain punishments. Hence of among certain
punishments, Imprisonment is that which is most
in use.

Simple afflictive punishments are not proper to be
substituted in the room of pecuniary at least in
the room of any but very high degrees of it, on
account of the quantity of Infamy necessarily connected with
the former of these punishments.
