Punishments Succedaneous.
When Quasi Imprisonment or Banishment are
the primary punishments there is seldom any idea
of running to the primary in case of its not
being submitted to. Imprisonment naturally occurs
as a more chargeable but more effectual means
of compassing the same end. One transgression of
the penal mandate is commonly looked upon taken as
a sufficient presumption that it will never be observed.
Laborious punishment requires in an uninterrupted
sense of past exertions of the will and order to
induce a man to submit to it. It requires a
constant application of fresh motives. These motives
must be such a pain as can be inflicted
in any degree however small, and can take effect
in within any portion of time however small after the
application. Such motives it a constant is only simple
afflictive Punishments [that] can supply. This The
necessity of this is universally understood and universally
provided for. Whenever a man is appointed to oversee
the labour work of workmen men who work involuntarily,
the power of applying correction as it is called
which is understood always to include the of inflicting that of inflicting
organical pain, is given to him as of course.
