Of Subsidiary Punishment

The breach of that easy obligation by which constitutes a chronical
punishment may be is constituted either temporary or perpetual.
When it is likely to be but temporary, it is
natural that the first-designed punishment should
be kept on foot; that by the supposition being the
punishment preferred. Now when by imprisonment is joined to any active punishment
is coupled with Imprisonment, a any breach of
the penal obligation is likely to be but temporary;
because so long as the Imprisonment continues, the
delinquent is forthcoming to receive at any time
such subsidiary punishment as is may be appointed to attend
the principal. When the breach of the penal
obligation is likely to be perpetual it is natural that
the first-designed punishment should be given up, and
the subsidiary punishment appointed to succeed supersede it through the whole course of its intended continuance. Now this is the case with Imprisonment,
Territorial Quasi-Imprisonment and Banishment:
for having once gained the opportunity, the same
motive that prompted him a man to withdraw himself from
(under) the punishment for one moment, would naturally
prompt him to keep himself out of it as long
as it was to last.
