Compensation takes place only in the case[s] where
from the mode of punishment that is adopted, there
is a quantity of the instruments of pleasure to dispose
of. It is therefore only an occasional, not a constant
object of attention in the [proceedings of] the Law.
Punishment is a necessary & constant object. Every thing is
done as by Punishment: nothing is done without it.
But compensation is only an accidental and occasional
ones.

Reformation is at bottom nothing by but Prevention, Prevention
considered in a narrower point of view. Prevention
as applied to directed towards a particular quarter. The only difference between the meaning of the two words is this. The way is to
use the word prevention when the mischiefs to be considered as being
prevented are those which are to be apprehended from
persons other than the delinquent who is in question.
They speak The way is to use the word reformation
when the mischiefs the consider'd as being to be prevented
are those further ones which are to be apprehended from persons
the delinquent himself.

For shortness sake and in compliance with the common
forms of speech, I speak of Prevention, Reformation
and Compensation respectively under the name of
ends of Punishment. But End is a word I have
be all along applied to real entities: to sensations: to
pains and pleasures: and neither Prevention, Reformation
nor Compensation are names of real entities. They are
fictitious entities: and no fictitious entity is predicable as
