Gentlemen
By a Letter Received last post from his Grace of York I am ——
Authorized by His Grace to refuse the Offer you made to him for the Purchase
of Land at Battersea intended to be taken from the See of York for the Building
Penitentiary House upon & other Purposes. I have likewise his Authority to say
That he can't by any means Approve of the proposal that the See shall receive
its consideration by Accepting an Equivalent in Land Which is proposed by
Lord Spencer to be given in Exchange for what I sold to the Publick. So far
as the Act of Parliament binds him, he must Comply, but an Exchange makes
no part of the Act; In that respect his Grace is left free, and it is his meaning
to continue so. The Proposal made by Sr G Elliott to his Grace he says was of
another kind and appeared very Equitable, that is. He proposed that when the
Sum to be paid by the Publick was setled It shod then be calculated what
way the proportionable Interest of the Lessee and what of the See of York
And that then each of the two partys shod
receive their proportion. In that
Case the money could be laid out in a Purchase for the See to the best ——
Advantage, not Confined to Battersea or any other Spot. I am Gentn
