Dear Sir,

I have talked with Burton upon the
subject of the King's Power of confing Prisoners
in such places as he shall think right — I
have also looked into the Books upon the
subject this morning, where there is in truth
very little to be found —

The result of both Inquiries is then, that
tho' such an opinion of the Kings authority
may formerly have prevailed and with reason yet the practice of
the Courts has so entirely superceded it, that it
is now scarcely worth inquiring into.

It seldom happens that the Court which passes
sentence of Imprisonment does not name the Gaol
in which the Punishment is to take place — If it
does not, it is understood that the common Gaol
of the County is intended.
