I. Indirect Prohibitions – instances

1. Appointing for the wrong a remedy, but rendering
expence of the only mode of making application
for it so expensive that the party
wronged is thereby disabled from
making the application requisite:
viz. for example by taxes imposed on the
use of the necessary &c written
instrument: those taxes being imposed
by and the produce collected
into the purse of government

2. So by taxes imposed in the
name of fees – by judicial
officers: they being empowered to
assess the tax, and put the produce
into their own pockets.

3. So by taxes which by the authority
of judicial officers, the law
assistants of parties are empowered to
impose upon their respective clients
or the antagonists of those same
Clients.

4. So by destroying the effect of
the demand on pretence
the ground of alledged inaptitude
on the part of the instrument.

II. Indirect Licences – instances

1. Prohibitions under a penalty:
but, in some instances, to an extent
more or less considerable, the penalty
not heavy enough to outweigh
the profit reaped by means
of the offence: the gathering in the net profit is
thus the subject matter of a the
virtual licence: the penalty and
with the whatsoever is paid
by the party so harmed paid
under the name of costs is in
this case the price paid for the
licence.

2. In the case of mendacity
licence, requisite made of the security in
some cases – not made in any others.

So, in so far as the expence
of suit for remedy for wrong is
greater than the wrongee can support,
the laws Statute
made and Judge made by
which that expence is produced
is a licence to committ wrongs
of all sorts at the charge of those
all those who are so unable.
