InstructionalArt. In the care of the Legislator it will belong as
so to order matters that in no case shall any remission instance
of any punishment appointed in that case by the
law, shall remission have place in any case that is to say
in which by those by whom its power is exercised
it was not intended to take place: nor therefore accordingly on any
other ground, nor from any other than some one
or other of those in which it was their intention it should
take place, nor by the instrumentality of any hand other than
those by whose instrumentality it was intended to take
place: nor by their own hands, in any sort of of case or individual
instance in which it was not intended by them to have
place.

Instructional
Art. 2 For want of sufficient examination attention scrutiny
into the consequences of the enactments made by them – looking
no further than the grammatical import of the words employed
by them, the Legislators of all nations have
hitherto been wont to give birth to results different from
and even opposite to those which on the several occasions they
respectively intended. Meaning, for example, or professing to mean to
produce the effect of a prohibition, they have produced the
effect produced by them has been that of a license: meaning or professing to mean to produce
the effect of a punishment, they have produced the
effect of a reward: meaning or professing to mean
to prevent the practice in question, they have promoted
it: they have encreased the frequency of it perhaps, or even given
birth to it.
