Constitutional Code
3. The hand by which the function is exercised
is a hand in relation to which it was not the intention
or at any rate the professed and supposed intention
of the superior constituted authorities, that it
should be reexercised.
4. This circumstance sufficient of itself to keep involved
in confusion all men's ideas as to the
ent effect of the contents of the penal branch of the
Law. One thing result throughout professed to be intended to be brought
about: another result, to an unmeasurable extent, actually
brought about, by the superior power in the State.
