Constitutional CodeCh. General Rules

Rule 11. Relatives in respect of action agency and
passion patientcy how denominated. Of the a person considered
in the character of agent the denomination ends in
– or or-er: of the person considered in the character of
patient or subject of the action, in – ee.

Examples afforded by English Law
1. Feoffer and feofee.
2. Curator and Curatee
3. Donor and Donee.

In In several instances however the application given
to this principle is incompleat.
Examples where a the denomination indicative of patientcy
is employed but not that of agency.

1. Trustee. No Trustor none no denomination for the Trustor
2. Committée applied to a person insane
when committed to the Guardianship, No denomination
for the Committer.
3. Legatee. No Legator: correspondent denomination correspondent in some respects but more
extensive, Testator.

See cases of trust three denominations are requisite.

1. One for the person party for whose sake benefit the obligation is imposed
and the correspondent power conferred. For this relation
the English law has the many worded and antique denomination
cestui que trust. Say for an all comprehensive expression, the benefitee; for
particular cases, correspondent to Curator, Curatèe: to Guardian, Guardee.

2. One for the person on whom the obligation is imposed
and the correspondent power conferred. Here comes in the English
law denomination – trustee.

3. One for the person by whom in virtue of power derived
from the law the obligation is imposed.
