Art. Note here that punishment being but one of a
number of remedies input requiring to be and capable of being
applied to the prevention of or stoppage of the criminal mode and courses
of action and their mischievous effects, hence in the nature of the case equally capable of being
remitted in the application of those other remedies. For the consideration
of the Legislature it will be whether in those other cases
to this same or any other functionary a remissive power applicable in relation to these other remedies can be given
in any case be given with advantage. But the Code to which this
question belongs is the the Penal Code.

Now In England, no crime has on no day has been committed that
crime, which under Judge made law has not had for its
instigators the Judges of all preceding days: the whole fraternity
of the highest Common Law Judges. No act At no time
has any act of assassination, for example, been committed; which
for the instigators has not had the whole brotherhood of those
Judges. In them may be seen – not merely assassins – but
assassins of the most maleficent description – assassins
for lucre. For the pieces persons to whom this secret power of
selling impunity has been committed by conferred on and secured to them are persons
by whose maleficent profit they are to the have at all times
by the whole amount of it been gainers: of those offices
they have at all times been patrons: and in every case
to the value be the office what it will, to the its value of it to
the incumbent, the value of it to the patron bears a regular
and universally ascertainable and undeniable proportion.
