As well might a man look into the the newspapers – see the debates of the two
assemblies of the Legislature, and give utter and publish as so
many masses of law – of Statute law – what he the conclusion
he finds it answer upon with his views to draw from what
he has said or heard of those Debates.

A time there was when such the practice of taking
for the standard of this substitute to real law might
not only be excused but justified: justified in the sense of
necessity. This was the time In this case is was the whole length of time
anterior to the time, at which the public mind had arrived
at such a pitch of maturity that the acknowledged government legislative
tive body had established itself in the practice of ordaining real
law. But those times have that time of immaturity has long been passed.
What is the consequence? that the people have been under the ever seen the
oppression by unpunishible oppressors and malefactors of two classes: legal
in the situation of legislative men who have left unperformed undone
this first of duties: judges who on false pretences, have
been exercising the powers of which they were all the whole conscious
of its not belonging to them: at thus usurping competence
instead of confessing their want of competence, and calling
for a supply to it: legislators who witnessing all the

of stopping it, connived at it, and drawn a sinister profit
from it.
