1823. June 13
Constitut. Code§. 2. Common Law

Penal lawyer lets the
assassin, at the command of
any one who will have them.

In the composition fabrication of the counterfeit law thus fabricated, the Judges
exercising the confirmatory function, the efficient and avowed instrument of
the Monarch it has been seen exercises the initiative: and
these being put together, and no other function in any other being interposed,
the fabric it is seen work it be may be seen is compleat.

But of this initiative is the the this efficient and avowed instrument
of the Monarch is far indeed from having
the exclusive possession to himself. It may be exercised by
any individual whatsoever, provided the majority of a Grand Jury were
at any time to found to give their fiat.

In the former case the usurping legislature consisted of two no more
long co-ordinates persons or sets of persons
quasi authorities an initiative, confirmative.

In this latter case there may be seen three co-ordinates:
– the prosecutor – the Grand Jury and the Petit Jury
under the direction – for hitherto as yet they have had in general had
the weakness to submitt to the direction of the Judge.

In this set of tasks thus situated the King Monarch with his avowed
instruments for the work of legislation have for ages been viewing
with indubitable the howsoever undeclared and secret satisfaction
the most mischievous and dirtiest of their work
done for them, without their done to their hands: done without
their being having in appearance, any perception of the fr nature
or existence of the pursuing of course of fraud that all along
carried on: work which a mixture of fear and shame
which fear, for in the to fear of a confidence thus instructed in power shame has no place fears so cased in power shame has no
place, would have suffered to prevent their executing with
their own hands their bearing any part in the execution
of. This will be seen presently.
