14. Determinateness of his lot.

Art. or XIV. Determinateness or indeterminateness of the
law of conduct requisite for deviation aberration from which functionaries condition lot in all respects
which by the effect of the appropriate Code the functionaries in
question are placed. I. Privates. For the effectuation of due determinateness
requisites necessary are the following.

1. That the Code be so formed powers should be so designed that under it no service
in any shape can by a superordinate be exacted by the hand
of a subordinate without indication given of some provision in particular as
may be by which the correspondent command is authorized
that therefore and that thence no hardship of the subordinate should not
be made to suffer any hardship for which by the terms of his
engagement he was not prepared: nor any any punishment
which it was not in his power to avoid.

2. That on the other hand in such shape and degree the powers should as such
possess such amplitude that on no occasion for pursuing
the ends of the institution it should be matter of necessity
to the superordinate to exceed the above powers by exceeding the above powers or otherwise
to violate the any part in any part of the engagement entered into by
the government with this class of its functionaries.

3. That on both accounts accordingly on the entrance of any individual
into the engagement by which he is attached to that Sub Department,
a compleat of the whole body of new law to which
he is thereby subjected should be delivered to him, with a
memorandum of the year month and day of his entrance into
the engagement, authenticated by the signature of the functionary
by whom on this occasion the government is represented.

4. Officer's situation. To the surprizes and shock which
it is the endeavour of this article memento to minimize the inferior situation
it is evident is much more exposed than the superior: the superior
less and less in proportion to his elevation: to the nearness of his approach
to the all-commanding will on which the lot of all who are
under him is at every moment of their lives depending.
