§. Dispensative functions

Not long ago a man cut off the hands of a four years
old child. He was prosecuted and tried: doubt of his guilt –
none in the mind of anyone. The Judge consent to him to be
acquitted. How? by assuring the Jury, it was their duty
to acquit him. Why? because on drawing up or copying a
paper belonging to the proceedings had made a mistake.

At the idea of the impunity thus given to the murderer was any
such sentiment as regret expressed. Not the smallest!
Any disposition to desire to see this mistake
in all its shapes due Not As little, the smallest.

It is for this cause on this consideration amongst others that the writer
of these pages has not scrupled to lay it down publickly as a
treason – that the most maleficent of all so called malefactors
has been a man of patron of beneficence in comparison of the least maleficent
of English Judges.

Such is the gauntlet which more than 6 years
ago has been thrown down(a), in the face of the whole fraternity
of English Lawyers of all sorts and sizes. Which of Who may the
them has even stept forward to take it up? Not any one.

People of England! How beg will you endure this.
