Some titles, by reason of the Influence of local
Circumstances, admit not of any such thing as a
portion of Law exhibited in terminis; in such
cases the whole Title will consist of Instructions
to the --- Legislator.
Book 2.
In Book 2. will be exhibited several Provisions which
seem proper to be established for the purpose of —
Constituting A System, or Body, of Penal Procedure
adapted to the several offences established in Book 1.
As in the case of the lesser Offences The penal Branch
of Legislation co-incides indistinguishably with
the Civil; what is here delivered concerning the
former will in many parts of it bear application
to the Latter.
As a Branch of the System of Procedure,
The Subject of Evidence will be sifted to the
bottom; Setting out with the metaphysical —
Principles of Belief, and concluding with the
Application of those Principles to Practise, in
terminis legis as before.
Along with the proposed words of the Law
will be given throughout the Reasons on which
it is founded. They are conceived in the
form of answers to the principal Questions
which it seems natural to imagine may be
proposed concerning it.
