Order of procedure

☞ Quere – How to reconcile the order pursued in Part I
Offences collectively considered, with the Order pursued in Part II
Offences severally considered? Order, in the first case, analytic:
in the other case, synthetic.

Answer. In both instances, the object is – saving
the necessity of repetition – avoidance of repetition.

In Offences collectively considered In the first seven of the seventeen Chapters of which
Part I. consists, the matter is merely Instructional,
Ratiocinative and Expositive: none of it, enactive = obligative.
In the ten other Secti Chapters the matter is enactive
besides answering those other purposes, has besides an
enactive effect: for, reference will be made to it on the occasion
of all the several Offences touched upon with
under the several heads contained in Part II. Offences severally
considered.

Accordingly, under in every head of Offence instance in
penning the matter contained under the denomination
of the particular offence examination will be to be made
of the matter of every one of the ten last Chapters of
Part I for the purpose of seeing what, if any, demand there will
be for the making application of it to the particular sort of Offence
which is the subject of enactment in Part II. Offences
severally considered.

In this case and thus far, – the general matter
comes before the particular. Why? Answer. To save the need
of repetition in the instance, of the what is Expositive, Ratiocinative
and Instructional: so also in the instance of what is
Enactive.
