Order of procedure
Now as to Part II. Offences severally considered,
considered in respect of the order pursued as between what
is general and what is particular.
In the case of Semi-public offences, the genera are
throughout more extensive than the corresponding Private
Offences: and again, in the case of Public Offences the
genera are more extensive than in the case of Semi-public
Offences.
The genera more extensive? How? in what respect
more extensive? Answer, in respect of the quantity of evil
respectively produced or liable to be produced: the magnitude
of the evil, as measured by its extent: – that is to say by the
number of the persons liable to become sufferers by it.
With understanding the effects – the evil effects produced
by the Offences belonging to Class I. namely Private Offences you cannot
understand the effect – the evil effect produced either an Offence belonging
to Class II. name Semi-public Offences, nor yet the effect – the
evil effect produced by an Offence belonging to Class III Public
Offences. Be the Semi-public Offence what it may, if it
were not productive of the effect – the evil effect – produced by
some genus of offence belonging to the class of Private Offences, it
would not be productive of any evil: and so in the case of Public
Offences. Be the Public Offence what it may, suppose it not
to be productive of any of the evil produced by any offence of
belonging to the Class of Private offences⊞ ⊞ meaning always, either
the evil of the 1st order
or the evil of the 2d order
or the evil of both orders
put together, – it would not be productive
of any evil whatsoever.
