Penal Code Introduction Rudiments

Degree of coincidence between the dictates of the principle General
Utility and the dictates suffrages of the popular and tribunal of public opinion or
moral Sanction.

To the application of the principle of Utility
if performed with degree of accuracy, calculation
the application of Arithmetic is altogether necessary. But on every occasion the
application of arithmetic is a dry and tedious process:
it is so even when the articles which are the
subjects of it are prominent and manifest,
more so must they be when not only for the
quantities no exact instrument of incarceration is
afforded by the nature of the case, but the articles
themselves pain and pleasure are to a great extent not capable of being brought to
light but by an intricate and complicated investigation:
many of them not being so much as received
from current language any settled denominations – any
settled appellations by which they may be denominated
indicated and distinguished.
