Penal Code or Law Amendment PropositionsCh. 11. Codification

That of the state of the human mind in that country and that
in which matters of the highest import to the happiness of the
community and even if the whole species are every day divided upon
the ground of arguments on grounds composed of nothing but mere nonsense.

As a ground for legislative enactments even the word justice
is too loose – in its import not sufficiently determinate.

For justice when an act is spoken of as being unfavorable
to justice an intelligible standard to which the act is in this way
composed is assumed: and by this word no such standard is
proposed.

If the act in ge thus said to be conformable to justice is this.
A determinate rule must be supposed to have been received
as conformable to the greatest happiness principle: an the act in
question may be regarded and spoken of as being conformable
to the greatest principle with abstraction made of all rules, or by
reason of its being in conformity to such supposed received rule.

This announcement thus and hereby made, thus he who by whom
these scraps of nonsense would otherwise have been
employed will if they persist in using them do so at
the risk of being proclaimed utterers of nonsense.
