III. Division of Offences

Class Individual-affecting Offences.

Subject matters of consideration, and sources of division
these –

Quarter affected: viz. person – reputation, property, condition
1. Quarter pleasurably or say beneficially affected
2. Quarter painfully or say burthensomely affected

1. Offences purely noxious or say burthensome
2. Offences preponderantly noxious or say burthensome

Offences purely noxious those whereby (the gratification
of the antisocial aptitude excepted) no pleasure or benefit in any
shape is produced

Offences preponderantly noxious, those by which
pleasure or say benefit is produced on both the side or
by the say part of the agent, but that pleasure or say benefit
is outweighed by pain or say burthen on the other side
or say part of the patient

Apply this distinction and correspondent division
to the class or order of Offences affecting person: and
among those to Offences affecting the body

To the Penal Code exclusively belongs the cognizance
of the Offences purely noxious: absolutely, efficient causes of justification
excepted, they will stand interdicted: and for
giving effect to the interdiction, the f remedies provided
will (all four sorts of them) be made applicable.

To the Civil Code as well as to the Penal will belong
the cognizance of the Offences preponderantly noxious
and the concession or denegation of the correspondent right
will in each case be determined by the consideration of the
question – which is the greatest – the benefit to the agent, or say
operator, or the burthen to the patient or say the parts
operated upon.
