Note that In the case of the Offences preponderantly noxious, generally
if not universally speaking, evil of the second order there is none.

Example – Instrument of Here comes in as
a subject of consideration, the physical instrument of maleficence
or say maleficent instrument: and herein
Instrument of maleficence, an immoveable
1. A tract of land by name of malaria, or
effectuation of excess or deficiency of water to the parts
damnified or say burthened.
2. An architectural erection or say building
whether for habitation or manufacture.

Malficent effect producible bad quality or excess or
defect in quality of 1. water, 2. air or 3. excess or defect in quantity of heat,
or 4. light.

Exempt if damage producible by excess of heat, 1. combustion,
2. explosion.

To apply to damage producible by combustion
the preventive remedy is the one object or say end in view
of the Building-regulation Enactments.

Maleficent instrument in edifice: maleficent operation collapsion: that is to say preponderance of the attraction
of gravity over the attraction of cohesion.
