Insolvency
For the present at least, so much for the blameless
now as to the blameworthy.
In regard to the blameworthy, the leading and
maxim – not indeed of law as it is, but of
law as it ought to be – not of English Jdge-made Jurisprudence
but of the most undeniable justice, suggested by the plainest
common usage is that when all is said and done
no man shall be suffered to profit by his own wrong.
Antecedent to all demand for ( withof) punishment,
antecedent to all demand or suffering on that score
comes the a demand for to this effect on the account of justice.
True it is that in English law the book of English law a maxim
to this effect is to be found. But like so many other maxims it is for show that
it is put there, not for use: by the breach is done all to it
all the honour that is done to it, not by the observance.
