The cause was heard on 6th May
1830, when the Master of Rolls made
a decree, declaring the Charity entitled to
one moiety of the estate at Barnett, and
durected an account to be taken of the
receipts of the Company on account of
that moiety since 1813, and an inquiry
as to their application thereof.

Proceedings have been had under the
decree before the Master in ascertaining
the arrears of tonnage rent directed to be
paid by the Earl. A receiver of the rents
of the charity estate has been appointed,
and the costs, as directed by the decree,
have been taxed, and were reported by
the Master on 30th November 1829.

A reference was made by order, dated
23rd March 1829, on petition of the trus-
tees, as to repairs of the chaplain's house.
The Master made hi report on 26th May
1829, which was confirmed by order,
dated 3d June 1829, and the costs of the
application were directed to be taxed
and paid.

The Master, on 29th March 1830,
made his report under the order of 1st May
1829, and the defendant has paid into
court the balance reported due from him.
The costs have been paid, and £.41. 9.1.
the balance of cash, has been invested in
£.3. per cent. Reduced Annuites, in ad-
dition to the £.1,000. original fund of the
charity.
The appeal was heard on the 9th Novem-
ber 1829, and the Lord Chancellor gave
his judgement thereon 1st June 1830,
affirming the decree of the Vice-Chan-
cellor, and directing the costs of the At-
torney General to be paid out of the
charity funds
