Now for matter of law, and matter of fact together. For
a sample specimen of the matter of law take for example the Statute Ao 1757 of George
3.G.2.c.24 the second Ao 1757 in and by which it is inserted §.11 that ...
"all persons who, knowingly and designedly, by false pretence
"or pretences, shall obtain from any person ... money ...
"with intent to defraud any person ... of the same ...
"shall be deemed Offenders against law and the public peace,
"and the Court, before whom such Offenders ... shall
"be tried, shall in case he ... be convicted ... order such
"Offender, to be put into the Pillory, or be publickly whipped,
"or to be transported ... for the term of seven years
