Demand on the ground
of legacy different from
other demands in point
of complication
The case of a demand on the ground of a legacy
differs in respect of its complication from those demands
which are in most common use.
Ingredients in the
efficient cause of right
of demand
Ingredients Elementary portions in the efficient cause of right is little
or say in the ground of demand
I Conditions positions
1 Last w Existence
of a last will with
administration or
executorship thereto
1. Existence of a last will in which
sums of money or moneys worth to a certain amount
being left to the proposed demandant by way of legacy
the proposed defendant is either in relation to such
will either 1 administrator with the same amount;
or 2. An Executor therein named as such: or 3. An
Executor of his own wrong, so stiled on the ground
of his actions as proprietor or trustee of some subject
matter of property belonging to the deceased at the time
of his death — so acting and the without authority from the
Law so to do.
2 Possession by
defendant Executor
or Administrator
of effects of deceased
2. The proposed Defendant so being Executor
or Administrator has, in his hands, or in his power
applicable to in the satisfaction of this demand on the whole or in part property
belonging to the deceased at the time of the deceased; or without his own de
