At this stage examination
upon oath required
But on the occasion at this stage of the suit, and for this purpose it
is expected of him that he shall examine the parties upon
Oath: which mode of inquiry, though if asseveration or
affirmation was substituted to Oath it is the only one subservient
and conducive to the ends of justice, will not when deferred
to this stage be adverse to the opposite and superior
namely the the accounts of the record at
to in the person of Noble and learned Lords
and gentlemen

Objection that this
series of reinquiries
will be the first not
the second
An objection which perhaps may here be made, is
that this series, this stiled the second, will not be the second
but the first: it being to be eventually interpolated between
the commencement of the suit, and that series which has
been styled the first. Of this objection we can not but acknowledge
the force: and from it we must leave it to the objector
to discuss whatsoever conditions appears to may have diction to it

Call this the series the first or second with which
in addition Reinquiry the first of a third series §.73.
Power to the Judge "to direct or cause to be directed for the
opinion of one of the Courts
Now in regard to the choice as between Court and
Court is any restraint had upon him. It may be not only
any Court of "Law" but moreover any Court of "Equity".
