But now as to the manner in which this same case
is to find its way into those same Courts? In the case of a Court
of law there may be no great difficulty. It may take the for
example the road which heads from the Quarter Sessions Court to
the Kings Bench. But from the Judge in Ordinary Court neither to
the Court of Chancery or any Chancery Court nor to any other Equity Court is there
any road as yet made. There must therefore be a New
Roads Act made for the purpose: a new King's Road – a
: call it accordingly in plain English
a trip road nor on the score ground of misnomers
will any objection be found to lie.
Then as to the sort of vehicle – what other can it
be other than a Bill in Equity?
True it is that such to the wording of this same
Section § 73 no such course can the case take, unless
it be "with the consent of both parties".
But here comes in this same Section lies hostile a lesson in no small degree
instructive. In it may be seen the opinion given by of one learned
draughtsman on the mental qualities of the several sorts
of persons concerned: of the intellectual moral qualities of learned
gentlemen of all sorts and sizes, official and professional: of
the intellectual qualities of the individuals in the character of suitors and Clients in the Counties of Kent-Durham
and Northumberland.
