Expense little as it
is how divided under
JB's system
In this case whatsoever may be the expense of
the least expensive mode of exhibiting it must it is sure be
borne by somebody. But will it, and
in all events, and in the first instance for bearing the whole
of it by the alledged legatee? No such thing. If, in regard
to the document in question, no sufficient ground
shall have been shewn by you for the suspicion
expressed by you as to its existence its validity or its
genuineness, the expense of the exhibition of it will ultimately
fall upon you: nor in relation to any other
of the alledged matters of fact will the inquiry be stopt a so much a minute
by doing such operation as may have to be
performed for the obtainment of that piece of evidence: and
as to the expense of it in the first instance, if in my eyes
there is any probability in the persuasion professed to
be entertained by the demandant, then and in that case
of, regard being had to your respective pecuniary circumstances,
he is not so well able to bear the expense
of the money necessary to be advanced for the obtainment of
the evidence as you can, I shall require you either to make the
the advance what to me seems proper or to pay to
deliver to him at once the money which in the s
of this same legacy appears to me to be his due.
