Neither with the quantity or quality of the subject matter
of dispute, nor with the nature of the matter of fact as the mode of making proof in relation to the matter
of fact in question anything to do: whether the subject matter
be a thing certain an individual moveable or immoveable, or an individual a sum of money
thing belonging to a certain species of things composed of individuals things antecedently at the pleasure of
the alledged debtor so they belong to the species in question
makes no difference.

So as to the species of matter of fact, by on which the title
to the possession of the subject matter in question is constitutive
suppose the death of one to whom the is in respect
of the subject matter in question of what he says is true next of : what matter
it whether it was natural or virtual: whether rightfully
or wrongfully, well had a cut a in the
production of it?

He who admitting that the summary mode of
proceeding admitts

So in regard to suit of a complicated texture.
No complex suit how complex so ever but is capable of being
resolved with the several simple ones of which it is composed:
such if resolved matter the existing system thus resolved
it is, or in relation to it justice is not done. And, as
to the several modes of complication, actual and possible
Mr Bentham has long ago brought them to light, and in his
work stiled Scotch Reform &c published as long ago
as the year 1806, there they may have been seen all
this time and actually have been seen by all persons
by whom fortitude enough could be mustered up sufficient
to enable them to the aspect of so many such number of such
objects.

He by whom it is admitted that this same mode of
procedure, the summary, is suitable well suited to its purpose in aptitude
to any one sort of suits – if so it be that he objects to the making
application of it to all sorts of suits without exception or to any one
other sort of suits, in him it is lies incumbent to show in what, if any
respect it fails to be
well suited to any
the subject matter of any
other sort of suit.
