Review
§. 3. Judicial functionaries
Mr Bentham of in every instance give the most precise
indication of the function – in other words of the powers and obligations
of every one of his several judicial functionaries. These parties
he b puts together, and ranks them under he sort of afforded by the
denomination of of each such functionary. To Till In each instance
the name of the sort functionary gives title to the Chapter: the delineation of his function taken in the aggregate gives title to
one of the Sections. By the name he gives to each species of functionary
indicated the nature of his function is indicated in so far as by a
single word, namely a noun substantive, or two words is the equivalent
consisting of a substantive and adjective, any such indication
can be afforded. In a word his denominations are instance characteristic expressive. Witness Men, Registrars. Prehensor. Messenger.
Prehensor. In no case by the name they assigned, is can any misconception
be produced.
Not so Mr Brougham. For otherwise Mr Brougham
1. A First as to the Registrar. To this functionary thus denominated
by him, Mr Brougham gives allots the functions which by this
denomination are in use to be suggested generally brought to view to everybody – and
in contemplation of which it must have of course have been that
Mr Bentham in his several works – the Constitutional and the Dispatch Bill took up and gave employment.
So for the most part does Mr Brougham, he gives assigns moreover to the functionary to a very different function of namely that
of : and in another other places those of a Judge. In one section
the Registrar is even set above the Judge the honest
acts the part of sets his Registrar Vice Judge over
Judge Places in which the occurs, 52: different
Section of the Bill.
Mr Bentham's Messenger carries Messages and he does nothing else.
Mr Broughams Messenger takes in hand in Mr Bentham's
time as will persons as things.
Mr Benthams Prehensor takes in hand persons and things
(meaning things corporeal) and disposes of them accordingly as the Judge him.
2 Mr Brougham have in the difference takes strong hold of a person or thing and delivers a message to
him: accordingly his Messenger does sometimes the one sometimes the other.
