Expositive.
Art. 1. By the Justice Minister remissive dispunitive function,
understand the power of preventing, in
part or in the whole, for ever for a time, the
execution production of any such hardship affliction as, in the name
of punishment, has been attached, to any act, thereby
dealt with in the character of an offence.

Art. 2. As to the relative time, at which, in the nature
of the case, power in this stage is capable of being exercised,
– it is with relation to the operation of pronouncing
sentence, either antecedent or subsequent: if antecedent
to sentence, it is either antecedent or subsequent, with
relation to commencement of pursuit.

Art. 3. Considered in respect of the quantum of
the effect, it admitts of the following diversifications.
It may be exercised –
1. By total remission: – by remission of the whole.
2. By partial remission: – by remission of a part.
3. By virtual partial remission: – by substitution of a less to
a more afflictive mode. This can not be without
the consent of the delinquent.
4. By sistition, or say suspension, made, of the execution, of the whole
or of this or that part; namely, for a time definite
or indefinite and if definite renewable.
